Terms of Service
Welcome to Rising Gamma. By using this website, you agree to these Terms of Service, which govern the use of available features, content, and information. Please read the following terms carefully.
Purpose of the Site
Rising Gamma website is designed to provide statistical and analytical tools based on data, intended to help users make informed decisions. However, Rising Gamma is not a broker, does not provide personalized financial advice, and does not solicit investments in any way. The information provided is exclusively for educational, informational, and analytical support purposes.
The analyses and insights provided are intended solely to offer an objective basis for reflection and should not be interpreted as a solicitation to buy, subscribe to, or sell any financial instruments of any kind. Rising Gamma explicitly states that it does not provide investment advice, financial recommendations, or trading signals. Past performance is not indicative of future results.
The use of analytical and statistical tools for financial market analysis involves significant risks. Any decision based on the information provided by Rising Gamma is made entirely at the user's discretion and responsibility.
Service Access Levels
Rising Gamma offers three distinct access levels. Tiers differ in the set of features they unlock, not in the volume of usage allowed for those features.
Free Access (No Registration Required): Visitors can access the basic analytical tools of the platform without creating an account, to evaluate the platform's capabilities. Free users are not required to create an account or provide registration data. Any cookie-based analytics, advertising or referral tracking in these areas is optional, activated only with your consent, and governed by our Privacy Policy and Cookie Policy.
Premium Membership (Registration Required):Access to the full set of advanced analytical tools, beyond the basic ones available to Free users. Requires account creation and paid subscription.
Pro Account (Registration Required): Everything available to Premium users, plus custom‑portfolio analytics over the statistical and temporal suite (returns distribution, volatility, cycle, Monte Carlo planning, recurring, correlation, beta, cointegration, asset ratio, simulation) and the white‑label PDF report function for delivery to end clients. Designed for financial professionals who use the platform within their advisory workflow.
Company Licenses (Corporate Plans): The Pro and Pro + Connections tiers are also available to companies as seat-based licenses, from a contractual minimum of five seats. The company buys the seats and administers them; each seat is then activated by one named individual on their own account. The provisions specific to this arrangement are set out in the "Company Licenses (Corporate Plans)" section below.
By choosing to create a Premium or Pro account, users explicitly acknowledge their intent to purchase a subscription and agree to provide accurate personal and billing information.
Paid Account Registration and Obligations
Registration for a paid account (Premium or Pro) is exclusively for users intending to subscribe to paid services. By providing personal information during registration, users confirm their commitment to maintaining an active subscription.
Registered Premium and Pro accounts are strictly personal and non‑transferable. Sharing login credentials, account access, or subscription benefits with third parties is strictly prohibited and may result in immediate account termination without refund.
Where access is provided through a company license, the license belongs to the company and may be revoked and reassigned to another person as the team changes. This does not make the individual account transferable: each person activates the license on their own account, and credentials must never be shared.
Users must provide accurate, current, and complete information during registration and maintain updated billing information throughout the subscription period. False or misleading information may result in account suspension.
Paid subscribers acknowledge that account creation constitutes acceptance of subscription terms and billing obligations as outlined in the subscription agreement.
Accuracy and Information Updates
The data and results presented in this platform are believed to originate from reliable sources. However, their accuracy and reliability are not guaranteed and should be independently verified by the user. Rising Gamma strives to provide accurate and up-to-date information but does not guarantee the completeness or timeliness of such information.
There is no obligation to update this information periodically, nor is there any liability for any potential inaccuracies. We assume no responsibility for errors, omissions, or any discrepancies in the content provided. The platform reserves the right to modify, update, or remove any information or content without notice.
Users of this service are encouraged to independently evaluate financial instruments and consult any other independent sources they deem necessary.
Use of Services and User Responsibility
The use of content and tools offered by Rising Gamma is at the user's sole risk. Those who use the analyses or data provided to make decisions do so independently and under their own responsibility. No responsibility is assumed for any losses resulting from the use or misuse of this platform or its content.
Financial markets and cryptocurrencies are highly volatile and subject to external influences, including economic, regulatory, and political events. Users are encouraged to carefully consider the associated risks, assess their experience level, investment goals, and risk tolerance before making any decisions. If necessary, consulting an independent financial expert is recommended.
Rising Gamma will not be liable in any case for financial losses, direct, indirect, incidental, or consequential damages arising from the use of the site's content or services. Premium subscription purchases represent a binding agreement with immediate billing obligations upon successful payment processing.
Tiered Access to Features
Access to the platform is organized in three tiers, plus the optional Connections add‑on available on the Pro tier ("Pro + Connections"). For the web platform, each tier unlocks a defined set of functionalities; there are no artificial daily limits on tool usage or rate caps tied to the tier itself. The difference between tiers is always which analyses and exports are made available, not how often a user can run them. The only exception is the Connections add‑on, whose remote API access carries the usage quota described in the dedicated section below.
- Free. Access to the basic analytical features of the platform. No payment required.
- Premium. Everything available to Free users plus the full set of advanced analytical tools, priority updates and access to features released during the subscription period.
- Pro. Everything available to Premium users plus custom‑portfolio analytics across the statistical and temporal suite (returns distribution, volatility, cycle, Monte Carlo planning, recurring, correlation, beta, cointegration, asset ratio, simulation, and the asset‑ratio companion analyses) and the white‑label PDF report function for delivery to end clients.
- Pro + Connections. Everything available to Pro users plus remote MCP access for the subscriber's own AI clients, as described in the "Connections: Remote MCP Access" section below.
- Company licenses. Pro and Pro + Connections are also sold to companies as seats. A seat unlocks the same features as the corresponding individual tier: what differs is who buys and administers it, and, for Connections, the pooled allowance described below.
Use of the platform for illegal purposes, unauthorized access attempts, data scraping, automated extraction, reverse engineering, or any activity that materially circumvents the boundaries of the subscribed tier is strictly prohibited regardless of access level.
Rising Gamma reserves the right to monitor aggregate usage patterns, apply reasonable technical safeguards (including rate limiting on specific endpoints in cases of abuse), and take appropriate measures to protect platform security and performance for all users.
Connections: Remote MCP Access
The Connections add‑on ("Pro + Connections") exposes the platform's analytical tools as a remote MCP (Model Context Protocol) server that the subscriber can connect to AI clients of their choice (for example Claude, ChatGPT, Cursor, or command‑line agents). The following terms apply in addition to all other provisions of these Terms of Service.
- License scope. MCP access is granted for the subscriber's personal or internal professional use through AI clients authorized on their own account. Reselling, sublicensing, redistributing or systematically re‑publishing the platform's data feeds or tool outputs, directly or through an AI intermediary, is not permitted.
- Authorization and revocation. Each AI client is authorized individually via OAuth with the subscriber's credentials and can be revoked at any time from the account area. Access ends automatically when the Pro + Connections subscription lapses or is downgraded.
- Usage quota and fair use. Remote MCP access includes a dedicated quota, currently up to 1,000 tool calls per day per account, together with a short-term per-minute limit that keeps the service responsive, designed for genuine agentic workflows. Preparatory requests that simply support an analysis, such as looking up an instrument, checking your remaining allowance, or validating a portfolio before running it, as well as reading the built-in knowledge base, are not counted against this allowance; only the analyses you actually run consume it. These quotas and rate limits are not fixed: Rising Gamma may modify them over time according to technical and sustainability criteria dictated by overall platform usage, so as to preserve service quality for all subscribers. The figures in force at any time are returned by the service itself (the get_quota tool). Attempts to circumvent the quota are a material breach.
- Company allowance. Where Connections is held under a company license, the allowance is pooled across the seats the company holds on that plan, currently 600 analyses per day for each such seat, and the individual per-account ceiling continues to apply to every person using one. The same exclusions for preparatory requests apply, and the same right to adjust the figures over time.
- No SLA. The MCP endpoint is provided "as available", without uptime guarantees or service‑level commitments.
- Third‑party AI outputs. AI clients are third‑party services operating under the subscriber's own agreement with their provider. Rising Gamma serves every tool output together with its context: a built‑in knowledge base covering the meaning of every input parameter, the methodology and the interpretation of every data series (the tool specifications, the platform knowledge base, the About content, the pricing FAQ and the tier descriptions). However, the AI client may transform, summarize or interpret those outputs in ways outside Rising Gamma's control: Rising Gamma is not responsible for the final result produced by the AI client, nor for decisions taken on its basis. The "Responsible Use" and "Liability Limitations" sections apply in full.
Company Licenses (Corporate Plans)
The Pro and Pro + Connections tiers are also offered as company licenses: a subscription entered into by a legal entity (the "Company") for a number of seats, rather than by an individual for themselves. The following terms apply in addition to all other provisions of these Terms of Service. Where a company license is concerned they prevail over any provision on account transferability, refunds, cancellation and the right of withdrawal; all other provisions of these Terms of Service continue to apply in full.
- Who contracts. The subscription is entered into by the Company, acting in the course of its business, through one or more individuals it designates as administrators. Whoever completes the purchase confirms that they are authorized to bind the Company and that the company details provided are accurate. Any VAT number entered during checkout is supplied to Paddle, our Merchant of Record, which uses it to determine the tax treatment of the purchase and to issue the invoice; the reverse charge, where it applies, is applied by Paddle and not by Rising Gamma.
- Seats and licenses. The Company buys a number of seats, subject to a contractual minimum of five. Each seat becomes a license with its own activation code, and each license grants one named individual access at the tier the Company purchased, for the subscription period.
- Assignment and reassignment. An administrator assigns a license by entering a colleague's work email; that person activates it on their own Rising Gamma account. A license can be revoked and reassigned to someone else as the team changes. Reassigning is a separate action from revoking, so a seat is never handed over unintentionally.
- Buying seats is not the same as holding one. Purchasing seats does not by itself give the purchasing administrator access to the paid tier. An administrator obtains access only by assigning a license to themselves, which occupies a seat like any other.
- Who can do what. Only administrators can buy, assign, revoke, suspend, reassign or cancel, and a Company may designate more than one so that it is never locked out of its own subscription. A person holding a license sees the platform at the tier the license carries and the details of that license; they have no access to billing, invoices, the list of colleagues or the company panel, and they cannot change the Company the license belongs to, change the authorized email, or cancel the Company's subscription.
- Revocation and suspension. Revoking a license ends that person's access immediately, including sessions already open, and returns the seat to the Company's pool. Suspension removes access while keeping the license tied to the person, and a suspended license still occupies a seat. Neither revocation nor suspension gives rise to a refund: the subscription is paid for the period regardless of who uses it, or for how long.
- Adding and reducing seats. Seats can be added at any time. They are billed only for the remaining fraction of the current period, they expire together with the seats already held, and the renewal date does not move; if the new total reaches a volume threshold, the better rate applies from that point. A reduction takes effect at renewal and is refused where it would bring the total below the contractual minimum or below the number of seats currently occupied: only seats that nobody is using can be given back.
- Permitted use. A corporate license covers the professional use of the platform by the Company's employees. What is not covered is the transformation of the platform, or of the data on which it is based, into something the Company provides as its own service: granting access to the platform to anyone outside the Company, reselling it or sublicensing it, or systematically redistributing the underlying data feeds and the raw results generated by the tools. The distinction lies between delivering the results of the Company's work to its clients, which is the purpose of the platform, and providing the platform itself.
- Record of administration. Assignments, invitations, revocations and the other administrative actions on the Company's licenses are recorded in a log the Company can consult from its panel.
- End of the subscription. When the Company's subscription expires, is cancelled, or remains unpaid, the licenses it pays for stop granting access. Each individual keeps their own Rising Gamma account, which returns to the free tier or to any personal subscription they hold separately.
- Colleagues' details. To assign licenses the Company provides the work email addresses of the people it wants to give access to. The Company confirms that it is entitled to provide those addresses for this purpose and to inform the people concerned. Each of them then uses their own Rising Gamma account, whose data is processed as described in our Privacy Policy.
- Business purchases and withdrawal. A company license is bought for business purposes: whoever completes the purchase is acting for the Company, in the course of its trade or profession, and not as a consumer. Rights of withdrawal under applicable consumer-protection laws, including, where applicable, Directive 2011/83/EU and its implementing legislation, are given to consumers, that is to natural persons acting for purposes outside their trade, business or profession. They therefore do not attach to a purchase made for business purposes, and the withdrawal option offered on the individual plans is not available on this path. Where the law that applies to a particular purchaser nevertheless treats them as a consumer, that law prevails over this paragraph, and nothing here limits the rights of anyone who buys an individual plan as a consumer.
Responsible Use of the Platform
Rising Gamma provides quantitative tools, statistical analyses and visualizations to support the user's independent decision making. The user is solely and exclusively responsible for the way the platform is used, for any decision taken on the basis of its outputs, and for any communication made to third parties (including end clients of financial professionals using the white-label report feature).
By accessing the platform the user acknowledges that:
- outputs are produced by deterministic models on end-of-day historical data and must not be construed as personalized investment advice, solicitation, portfolio management or any other regulated financial service;
- critical figures should be cross-checked independently before any operational, contractual or regulatory use;
- the user will not rely on a single platform output as the exclusive basis for high-stakes decisions, nor present such output to clients or counterparties as a substitute for a qualified professional assessment;
- the user will respect rate limits, fair-use policies and any quota associated with the chosen subscription tier, will not share account credentials, will not attempt to circumvent tier gating, and will not scrape, reverse-engineer or redistribute the platform's outputs in bulk;
- where the platform is used to generate documents for clients (e.g. white-label PDF reports), the professional issuing the document remains the sole author and is responsible for its interpretation, suitability assessment and delivery.
Depending on the subscription tier in force, certain functionalities of the platform may expressly enable the user to make commercial use of the information, outputs and documents generated through them. Where such commercial use is enabled by the functionality itself within the corresponding tier, it is permitted strictly within the scope defined by that functionality. Any commercial use outside of these expressly-enabled flows, including resale, public redistribution or systematic exploitation of the platform's outputs, requires the prior written consent of Rising Gamma.
Rising Gamma may suspend or terminate access in case of repeated or material breach of these responsible-use principles, without prejudice to any other remedy provided by applicable law.
Intellectual Property
All content, logos, and analytical tools on Rising Gamma are exclusive property. Any reproduction, distribution, modification, or commercial use without prior written consent from the owner is prohibited. This applies to both free and premium content.
Advertising, Affiliate Links and External Links
The platform may display advertising served by third-party advertising networks (for example, Google AdSense), particularly in free access areas. Such advertising may rely on cookies or similar technologies that are activated only with your consent and are described in our Cookie Policy; Rising Gamma does not control the content of third-party advertisements.
The platform may also contain affiliate links to third-party products, services or content (for example, videos, books or courses). Where such links are present, Rising Gamma may receive a commission if you purchase through them, at no additional cost to you. Any such content is selected on the basis of an internal quality screening, but its inclusion does not constitute an endorsement, a recommendation, or investment or financial advice, and you remain solely responsible for your purchasing decisions.
Conversely, Rising Gamma participates in affiliate and referral programs through which third-party partners may direct users to the platform. Where a user arrives through such a partner, a referral identifier may be processed, only with your consent and as described in our Privacy Policy and Cookie Policy, to attribute a subsequent subscription to the referring partner.
Rising Gamma does not control or guarantee the accuracy, legality or availability of the content of linked third-party sites and assumes no responsibility for any damages resulting from accessing such external sites. Visiting third-party sites is subject to their own terms and privacy policies.
Changes to Terms of Service
Rising Gamma reserves the right to update or modify these Terms of Service at any time. Changes will take effect immediately upon posting to the site. Registered paid subscribers and the administrators of company licenses will be notified of significant changes via email. All users are encouraged to periodically review this page to stay informed of applicable terms.
Security and Data Protection
Rising Gamma uses advanced IT security measures to protect user data, including encryption, firewalls, and controlled access. However, no system can guarantee absolute security. Premium subscribers are responsible for keeping their login credentials confidential and secure.
Free users are not required to provide registration or account data. Any first-party analytics, advertising or referral tracking that may apply in free areas is activated only with your consent and is governed by our Privacy Policy and Cookie Policy. For Premium and Pro subscribers, data collection and processing are governed by our Privacy Policy, and users consent to such processing upon account creation.
Where a company buys licenses, it supplies the work email addresses of the colleagues it wants to give access to, and confirms it is entitled to do so. Those people hold their own accounts, governed by our Privacy Policy; what the company sees from its panel is the status of its licenses and the administrative log described in the "Company Licenses" section.
Data may be supplied by third parties and may not reflect real-time prices or actual market conditions. Therefore, Rising Gamma disclaims any liability for any losses or damages resulting from the use of the information available on the website.
Liability Limitations
Rising Gamma does not guarantee that services will be free from interruptions, errors, or technical vulnerabilities. We are not responsible for any malfunctions, data loss, or other technical problems that may arise from platform use, regardless of access level.
Rising Gamma is not a broker, does not execute trades on behalf of users, and does not guarantee the accuracy, timeliness, or completeness of the data and information provided on this site. Past patterns and returns cannot predict future performance.
Resolution and Complaints
Rising Gamma reserves the right to suspend or terminate user access in case of violation of the Terms of Service. For Premium subscribers, account termination may result in immediate loss of access without pro-rated refunds. For questions, complaints, or requests for clarification, please refer to the Contact section.
Applicable Law and Jurisdiction
These Terms of Service are governed by Italian law and EU regulations for applicable users, or other applicable local laws for international users. For any disputes, the competent court is that of the Data Controller's headquarters.
Payments
Paid subscription fees (Premium, Pro and Pro + Connections) are charged annually in advance and are exclusive of any applicable taxes. The price and currency shown at checkout are localized by Paddle to your country of residence, where any VAT or sales tax is also calculated and applied. Prices are subject to change with appropriate notice to existing subscribers. Subscriptions automatically renew unless cancelled in accordance with applicable laws and our cancellation policy.
Subscription Management: Subscribers may cancel or downgrade their subscription at any time through their account settings. Cancellation and downgrade take effect at the end of the current annual billing period. Subscribers will continue to have full access to their paid features until the subscription expires. Switching the Connections add‑on on from an active Pro subscription is an upgrade applied immediately with prorated billing; switching it off takes effect at the end of the current billing period. No refunds are provided for unused portions of the subscription period, except as required by applicable consumer protection laws.
Company Licenses: Company subscriptions are billed annually in advance for the number of seats purchased, exclusive of any applicable taxes. The per seat price and any volume rate that applies to the chosen seat count are shown at checkout, localized by Paddle to the Company's billing country. Where the Company is established in the EU and provides a valid VAT number, Paddle applies the reverse charge where it is due; outside the EU, Paddle collects any local tax where required. Seats added during a period are billed only for the remainder of that period and do not move the renewal date. Company subscriptions renew automatically unless cancelled before the end of the current period, and no refund is due for seats left unassigned, for licenses revoked, or for any unused portion of the period.
Merchant of Record and Payment Processing: All payments are processed by Paddle.com as our Merchant of Record. For refunds, cancellations, and billing inquiries, Paddle will automatically apply withdrawal rights according to the laws of your country of residence.
14-day guarantee on individual plans: anyone who buys an individual plan (Premium, Pro or Pro + Connections) can withdraw from it within 14 days of purchase and get the full amount back, with no proportional reduction even if the platform has already been used, and without giving a reason. Rising Gamma offers this as a commercial guarantee to every buyer of an individual plan, not only to those whom the law entitles to it, and it is granted in addition to the rights that applicable consumer-protection laws already give the buyer, never in place of them: where those laws grant a longer period or better terms, they prevail. It is exercised from the account area. It does not extend to company licenses, which are covered by the "Company Licenses (Corporate Plans)" section.
Consumer Rights: Your statutory consumer rights are not affected by these terms. You have withdrawal rights according to the applicable laws of your country. For detailed information about refund policies and procedures, please refer to Paddle's Terms and Policies.
Premium subscribers can manage their subscription, including cancellation, through their account settings or by contacting Paddle directly as the Merchant of Record responsible for all billing and refund matters.
The data and analyses available through Premium subscriptions are strictly for informational and educational purposes and do not constitute financial advice, investment recommendations, or solicitation to buy or sell financial instruments or cryptocurrencies.
